Privacy Notice

1 Compliance

This Privacy Notice is designed to assist you to understand how we collect, use, disclose and/or process the personal data you have provided to us, as well as assist you in making an informed decision before providing us with any of your personal data.

In connection with collecting, using, disclosing and/or processing your personal data, Tokyo Electron Singapore Pte. Ltd. (“TSI”) will comply with Singapore’s Personal Data Protection Act 2012 (the “PDPA”) and other applicable data protection laws and regulations.

This Privacy Notice shall be read together with the TEL Group Privacy Policy and the TEL Group Privacy Notice available at https://www.tel.com/privacy/. In the event of any inconsistency, this Privacy Notice shall prevail.

2 Introduction to the PDPA

“Personal data” is defined under the PDPA to mean data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organisation has or is likely to have access. Common examples of personal data could include names, contact information, photographs and video images.

TSI will collect your personal data in accordance with the PDPA. In general, before TSI collects any personal data from you, TSI will notify you of the purposes for which your personal data may be collected, used and/or disclosed, as well as obtain your consent for the collection, use and/or disclosure of your personal data for the intended purposes.

Your personal data may also be collected, used or disclosed if TSI has assessed that to do so would be in TSI’s legitimate interests and beneficial to the public. Before doing so, TSI will take steps to ensure that any adverse effects that might arise for you have already been identified and eliminated, reduced or mitigated.

3 Purposes for Collection, Use and/or Disclosure of Personal Data

TSI may collect, use and/or disclose the personal data provided by you to TSI for the following purposes:

(a) considering whether to provide you with the products and/or services you applied for;
(b) processing your application/transaction for TSI’s products and/or services;
(c) conducting business with you and providing you with TSI’s products and/or services, including sharing Personal Data with TEL Group entities located outside of Singapore to provide you with the products and services you request for;
(d) administering and/or managing your relationship with TSI, including business and contact management;
(e) record-keeping purposes;
(f) storage, hosting back-up and disaster recovery;
(g) carrying out your instructions or responding to any enquiries by (or purported to be given by) you or on your behalf;
(h) dealing in any matters related to the products and/or services which you have applied for;
(i) planning, developing, and improving our products and services, and considering measures to enhance customer satisfaction;
(j) conducting research and development, including analysing and visualising the specialised fields and professional relationships of engineers using information from published patents and academic papers, for the purposes of research and development, as well as sales and business development activities;
(k) managing intellectual property including, but not limited to, patents, copyrights, trademarks, registered designs;
(l) making business travel arrangements;
(m) developing, designing and providing you with any after-sales service (such as maintenance services) in relation to any products and/or services provided to you by TSI;
(n) contacting you or communicating with you via phone/voice call, text message, fax message, e-mail and/or postal mail for the purposes of conducting marketing and sales efforts in relation to any products and/or services provided by TSI but only to the extent that you provide such contact details to TSI;
(o) contacting you or communicating with you via phone/voice call, text message and/or fax message, email and/or postal mail for the purposes of administering and/or managing your relationship with us such as but not limited to communicating information to you related to your application/transaction with us;
(p) conducting questionnaires, surveys, and organizing events;
(q) administering and/or managing TSI’s public relations and investor relations activities;
(r) managing corporate governance, risk, and compliance, including internal research and responding to legal processes;
(s) assessing and managing applicants and/or candidates for employment, including recruitment-related communications, assessment of applicant’s skills, qualifications and suitability for the role and pre-employment screening.
(t) confirming visitors and their health conditions to ensure health and safety;
(u) producing or promoting images or videos for marketing purposes, and posting on TEL Group pamphlets, websites and social media, including Youtube, Twitter, Facebook, Instagram, LinkedIn, Naver, WeChat and other social networking services, with your consent where required,
(v) complying with applicable law in administering and managing your relationship with TSI;
(w) comply with legal or regulatory obligations or TSI’s policies and procedures;
(x) responding to legal processes, pursuing legal rights and remedies, defending litigation and managing any complaints or claims;
(y) to fulfil any other purposes for which you have provided the information;
(z) where it is in the legitimate interests of TSI or another person and the legitimate interests of TSI or other person outweigh any adverse effect on you; and
(aa) any other incidental business purposes related to or in connection with the above.
(collectively, the “Purposes”).
In order to conduct our business operations more smoothly, TSI may also be disclosing the personal data you have provided to TSI to TSI’s third party service providers, agents and/or TSI’s affiliates or related corporations (including TSI’s parent company), and/or other third parties whether sited in Singapore or outside of Singapore, for one or more of the above-stated Purposes. Such third party service providers, agents and/or affiliates or related corporations (including TSI’s parent company) and/or other third parties would be processing your personal data either on TSI’s behalf or otherwise, for one or more of the above-stated Purposes.

If TSI uses the personal data for any other purposes than the above, TSI will notify you and obtain your express consent for the collection, use and/or disclosure for such other purposes in advance, unless processing of your personal data without your consent is permitted by the PDPA or by law.

In the event that TSI amends or alters the existing purposes of collection, use and/or disclosure, TSI will notify you of such changed purposes or will publicly announce such changed purposes in advance, unless any exception applies.

4 Security Control

TSI will endeavor to take commercially reasonable measures in order to prevent unauthorised access, collection, use, disclosure, copying, modification, loss, destruction, alteration and/or leakage of the personal data, and to ensure that sufficient security procedures and protocols are in place for the personal data. TSI will continuously review and will continually strive to improve the handling of the personal data.

However, TSI cannot assume responsibility for any unauthorized use of your personal data by third parties which are wholly attributable to factors beyond our control.

5 Maintaining Accuracy

TSI shall make reasonable efforts to ensure that personal data collected by or on behalf of TSI is accurate and complete, if the personal data (i) is likely to be used by TSI to make a decision that affects you; or (ii) is likely to be disclosed by TSI to another organization.

However, this means that you must also update us of any changes in your personal data that you had initially provided TSI with. TSI will not be responsible for relying on inaccurate or incomplete personal data arising from your failure to
update us of any changes in your personal data that you had initially provided TSI with.

6 Specific Issues for the Disclosure of Personal Data to Third Parties

TSI respects the confidentiality of the personal data you have provided to TSI. TSI will not disclose any of your personal data to any third parties without first obtaining your express consent permitting TSI to do so. However, please note that TSI may disclose your personal data to third parties without first obtaining your consent in certain situations, including, without limitation, the following:

1. Cases in which the disclosure is required based on the applicable laws and/or regulations;
2. Cases in which the disclosure is necessary to respond to an emergency that threatens the life, health or safety of the individual or another individual;
3. Cases in which there are reasonable grounds to believe that the health or safety of the individual or another individual will be seriously affected and consent for the disclosure of the data cannot be obtained in a timely way, provided that TSI shall, as soon as may be practicable, notify the individual whose personal data is disclosed of the disclosure and the purposes of the disclosure;
4. Cases in which the disclosure is necessary in the national interest;
5. Cases in which the disclosure is necessary for any investigation or proceedings;
6. Cases in which the personal data is disclosed to any officer of a prescribed law enforcement agency, upon production of written authorisation signed by the head or director of that law enforcement agency or a person of a similar rank, certifying that the personal data is necessary for the purposes of the functions or duties of the officer; or
7. Cases in which the disclosure is to a public agency and such disclosure is necessary in the public interest; or
8. Cases in which the disclosure is allowed by the applicable laws and regulations provided that such disclosure comply with the requirements of such laws and regulations.
The instances listed above are not intended to be exhaustive. For more information on the exceptions, you are encouraged to peruse the First and Second Schedules of the PDPA which are publicly available at https://sso.agc.gov.sg/.

In the event that TSI entrusts a third party with the handling of personal data, TSI will endeavor to provide adequate supervision over the handling and administration of your personal data by such third parties, as well as to provide for adequate forms of protection over such personal data.

7 Request for Access, Correction and/or Porting of Personal Data

You may request to access, correct and/or port the personal data currently in TSI’s possession or under TSI’s control at any time by submitting your request in writing or via email to our Data Protection Officer at the contact details below:

If you request to access, correct or port your personal data, TSI shall only respond to such requests after your identity has been reasonably verified.

For requests to access personal data, TSI shall comply with your request within thirty (30) days of receiving your request and reasonably verifying your identity. Where TSI cannot meet the above time frame, TSI will inform you of the reasonably soonest time in which TSI will respond. If TSI decides to reject your access request, TSI will notify you of the rejection. TSI shall be entitled to charge you a reasonable fee for the handling and processing of access requests.

For requests to correct personal data, TSI shall correct your personal data as soon as practicable after the request has been made, unless TSI rejects your request. TSI shall also send the corrected personal data to every other organisation to which the personal data was disclosed by TSI within a year before the date the correction was made, unless that other organisation does not need the corrected personal data for any legal or business purpose. Notwithstanding the preceding sentence, TSI may, if you consent, send the corrected personal data only to specific organisations to which the personal data was disclosed by TSI within a year before the date the correction was made.

8 Withdrawal of Consent

If you had previously consented to the collection, use and/or disclosure of your personal data in accordance with the specified purposes but wish to withdraw such consent, please contact TSI immediately and TSI will process your request within a reasonable time. Thereafter, TSI will refrain from collecting, using and/or disclosing your personal data in accordance with the specified purposes to the extent that you have withdrawn your consent for TSI to do so.

However, your withdrawal of consent could result in certain legal consequences arising from such withdrawal. In this regard, depending on the extent of your withdrawal of consent for TSI to process your personal data, it may mean that TSI will not be able to continue with your existing relationship with TSI or the contract you have with us may have to be terminated.

9 Retention of Personal Data

TSI shall take commercially reasonable efforts to destroy or anonymise all personal data within TSI’s possession or under TSI’s control as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any other legal or business purposes.

10 Transfer Out of Personal Data

Where your personal data is to be transferred outside of Singapore, we will ensure that such transfers are compliant with the requirements under the PDPA. Furthermore, TSI will not transfer your personal data to any party outside of Singapore unless TSI is able to ensure that the foreign recipient organisation of the personal data is bound by legally enforceable obligations to provide the transferred personal data a level of protection that is at least comparable to the protection under the PDPA.

11 Complaint Process

If you have any complaint or grievance regarding about how TSI is handling your personal data or about how TSI is complying with the PDPA, TSI welcomes you to contact us with your complaint or grievance.

Where it is an email or a letter through which you are submitting a complaint, your indication at the subject header that it is a PDPA complaint would assist us in attending to your complaint speedily by passing it on to the relevant staff in TSI to handle. For example, you could insert the subject header as “PDPA Complaint”.

We will certainly strive to deal with any complaint or grievance that you may have speedily and fairly.

12 Updates to this Privacy Notice

As part of TSI’s efforts to ensure that TSI properly manages, protects and processes your personal data in compliance with applicable laws and regulations, TSI will be reviewing our policies, procedures and processes from time to time.

TSI reserves the right to amend the terms of this Privacy Notice at TSI’s absolute discretion. Any amended Privacy Notice will be posted on the Tokyo Electron Limited website and can be viewed at https://www.tel.com/privacy/. Your continued use of our services and/or our website, as the case may be, following any amendment of this Privacy Notice will signify your assent to and acceptance of its revised terms as well as your consent to your personal data being processed in accordance its revised terms.
