Thank you (candidates) for your interest in the position offered by Tokyo Electron (Shanghai) Limited (“we” or the “Company”)!
If you choose to participate in our recruitment activities by registering a personal account on the company's Workday platform (https://tel6.wd3.myworkdayjobs-impl.com/en-US/External_Career_Site_TES), we will process your personal information as needed for the recruitment (such processing may include but not limit to, collecting, storing, using, processing, transmitting, providing, disclosing, deleting, etc., hereinafter the same). We attach great importance to the security of your personal information. Please read this Personal Information Processing Consent Form ("this Consent Form") carefully to understand our rules for processing your personal information.

Please read this Consent Form carefully. We will collect, process, and take appropriate measures to protect the personal information we collect in accordance with the requirements and provisions of the Personal Information Protection Law of the People's Republic of China (“PIPL”) and other related laws and regulations. Before you provide us with any of your personal information, you should have carefully considered it and hereby confirm that such provision is voluntary and appropriate.
I. How We Collect Your Personal Information
By "personal information," we mean identified or identifiable information recorded electronically or otherwise relating to you or other individuals, excluding anonymized information. We will collect your personal information in the following ways: 1. Personal information collected during your registration process on the Company's Workday platform, such as your name, nationality, contact information (mobile phone or telephone number), professional experience, educational background, and correspondence address. 2. We may collect your personal information directly from your resume submitted directly through the Company's Workday platform. 3. Obtaining your personal information from third parties, such as obtaining your personal information from third parties during a candidate background check. 4. Obtain your personal information that has been legally disclosed, such as by querying your personal information on the China Enforcement Information Disclosure Website.
II. How We Use Your Personal Information
1. We will process your personal information for the following purposes: (1) We will use the personal information contained in your Workday account registration and resume to understand your basic situation, contact you, and assess whether your qualifications meet the requirements of our job descriptions. Personal information that may be contained in your resume including but not limited to: name, gender, age, mobile phone number, email address, home address, personal photo, political status, place of origin, household registration, education, work experience, social practice experience, qualification certificate information, awards, and other personal information you list on your resume. (2) We will use the contact information from your previous work experience to verify your work experience and assess whether you meet the requirements of our job descriptions. (3) We will use your educational background information and qualification certificate information to verify your qualifications and assess whether you meet the requirements of our job descriptions. (4) We will use your gender information for internal statistics and data analysis to improve the Company’s internal processes and human resources policies related to diversity and inclusion. (5) If you are successfully hired, we will use the information you submitted during the job application process to establish employee files and complete onboarding procedures. (6) If you are not accepted, your resume and personal information will be included in the Company’s talent pool for the Company to select suitable candidates in future recruitment. 2. We process your sensitive personal information, including but not limited to the following: (1) Your ID card or passport or other documents that can prove your identity. This information is important for us to verify the authenticity of your identity. (2) Your medical examination report and other information, which are important for us to understand your health status.
III. How We Entrust The Processing, Sharing, Transfer To Overseas Locations, And Public Disclosure Of Your Personal Information
1. Delegated processing
To achieve the purposes for which we use your personal information as stated in this Consent Form, we may entrust and authorize third parties (“Authorized Parties”) to process your personal information, such as background investigation companies. We will require authorized parties not to process your personal information beyond the scope of our authorization and will require them to take measures to protect the security of your personal information.
2. Sharing
We may provide your resume to our affiliated companies to assess whether you meet the requirements for the positions we are hiring for. The affiliated company will use your resume to learn about your basic identity, contact you, and assess whether your qualifications meet the requirements of the relevant job descriptions.
3. Transfer
We will not transfer your personal information to any company, organization, or individual without your explicit consent.
4. Cross-border transfer
We may provide your resume, work experience, educational background, qualifications, and all other job application information to our overseas group companies in order to assess whether you meet the requirements of our job openings, process your application, and conduct internal statistics and analysis.
5. In principle, we will not disclose your personal information to the public or unspecified individuals, except as required by our agreement with you or by laws, regulations, regulatory requirements, or judicial authorities.
IV. How We Store And Protect Your Personal Information
1. If you are formally hired by us, we will continue to store and use your personal information as employee personal information. We will issue you a separate document regarding the Company’s internal privacy policy and rules for handling your personal information after you are formally hired, which shall then supersede this Consent Form. 2. If you are not hired by us, your resume and personal information will be included in the Company's talent pool for future recruitment. If you wish for us to destroy your resume immediately after the recruitment process concludes and to delete or anonymize your electronic resume and all personal information, please contact us using the contact information listed in Article VIII of this Consent Form. 3. We will protect your personal information in accordance with laws and regulations related to personal information security and protection, and will take measures including but not limited to the following to prevent your personal information from being lost, misused, accessed without authorization, disclosed, altered, or destroyed: (1) Your personal account and electronic data transmission will be encrypted, and data access will only be granted to the Company’s relevant personnel relating to the recruitment; (2) Regularly provide cybersecurity and privacy protection training to the Company’s relevant personnel relating to the recruitment; and (3) Conduct data security and personal information security impact assessments and personal information protection compliance audits.
V. How Do You Manage Your Personal Information
1. During the period we retain your personal information, you may contact us through the contact information listed in Article VIII of this Consent Form to request the deletion of your personal information if any of the following circumstances occur:
(1) In accordance with this Consent Form or other agreements between you and us, the retention period for your personal information has expired, the purpose of processing has been achieved or cannot be achieved, or it is no longer necessary to achieve our purpose of processing;
(2) You have withdrawn your consent to our processing of your personal information;
(3) Our processing of your personal information violates the terms of this Consent Form or other agreements between you and us; or
(4) Other circumstances as stipulated by laws and regulations.
However, please note that if the retention period as stipulated by laws and administrative regulations has not expired, or if deleting your personal information is technically difficult, we will continue to store your personal information and take necessary protective measures in accordance with laws and regulations, but we will not use your personal information for other processing activities.
2. During the period we retain your personal information, you may contact us through the contact information listed in Article VIII of this Consent Form to request the withdrawal of your consent regarding the personal information we process based on your consent. Once we receive your request to withdraw your consent, we will no longer use your personal information for the intended purpose and will delete or anonymize your personal information. However, your decision to withdraw your consent will not affect the personal information processing activities previously carried out based on your consent. Please understand that your personal information is required for the recruitment process to be completed, and if you withdraw your consent, it may affect your job application.
3. For your requests regarding access to, copying, supplementation, correction, deletion, withdrawal of consent, and transfer of personal information to third parties, we may require you to provide your identity verification documents to ensure security. We will respond to your request within the time limit as stipulated by laws and regulations after verifying your identity.
4. For your repeated requests within a certain period of time that exceed reasonable limits, or requests that require excessive technical means or present other significant difficulties, we will provide you with alternative methods.
5. We will be unable to respond to your request in the following circumstances:
(1) Related to our fulfillment of obligations as stipulated by laws and regulations;
(2) Directly related to national security and defense security;
(3) Those directly related to public safety, public health, and major public interests;
(4) Directly related to criminal investigation, prosecution, trial, and execution of judgments;
(5) We have sufficient reasons to believe that your request is malicious or an abuse of your rights;
(6) For the purpose of protecting your or other individuals' life, property, or other significant legitimate rights and interests, when it is difficult to obtain your consent;
(7) Responding to your request would seriously harm the legitimate rights and interests of the data subject or other individuals or organizations; or
(8) Involving trade secrets.
VI. Our Processing Of Minors' Personal Information
1. We do not accept applications from minors under the age of 18, and we do not collect personal information from minors under the age of 18. 2. If we discover that a minor has concealed their identity when applying for a job and has provided us with personal information, we will delete the personal information submitted to us by the minor. For those who have already been hired, we will terminate the employment contract and delete the personal information of minors submitted to us.
VII. Update Of This Consent Form
We reserve the right to update or amend this Consent Form from time to time. If there are any updates or modifications, we will promptly publish the latest version of this Consent Form on the Workday platform, indicating the update or revision date.

IX. Dispute Resolution And Validity
1. The interpretation and dispute arising from this Consent Form shall be governed by the laws of the People's Republic of China. Any dispute relating to this Consent Form shall be resolved amicably through negotiation between the parties. If the dispute cannot be resolved through negotiation, you hereby agree to submit it to the Shanghai Arbitration Commission for arbitration in Shanghai. 2. If any provision of this Consent Form is held or ruled invalid by a court of competent jurisdiction, such provision shall be removed from this Consent Form. However, the invalidity of this clause shall not affect the validity of the remaining clauses of this Consent Form. 3. This Consent Form shall be read together with the TEL Group Privacy Policy and the TEL Group Privacy Notice available at https://www.tel.com/privacy/. Except as expressly provided herein, the TEL Group Privacy Notice shall remain applicable and supplemental to this Consent Form to the extent permitted by the PIPL and other related laws and regulations. In the event of any inconsistency or conflict between the TEL Group Privacy Notice and this Consent Form, the latter shall prevail.
